The Spaculture brand, company USSPA s.r.o., IN 63218003, with its registered office at Dolní Dobrouč 384, postal code 561 02, registered in the Commercial Register maintained by the Regional Court in Hradec Králové, Section C, insert 7850 (“Spaculture” or “we”) declares that all processed personal data will be treated as strictly confidential and in accordance with applicable legal regulations in the field of personal data protection, in particular the General Data Protection Regulation (EU) 2016/679 (“GDPR”). The security of your personal information is a priority for Spaculture. For this reason, on this page we inform you about the data we store and explain why we need this data and how you can influence its processing.

USSPA s.r.o., a company registered at IN 63218003, with its registered office at Dolní Dobrouč 384, postcode 561 02, acts as the controller of your personal data. The company is registered in the Commercial Register kept by the Regional Court in Hradec Králové, Section C, File 7850. USSPA s.r.o. collects, stores and uses (or otherwise processes) your personal data for the purpose of carrying out its business activities. The specific purposes for which your data is processed are detailed below for each category of data subject.

Legal grounds for processing personal data

This Privacy Policy applies to all personal data processed by Spaculture (i) during your use of the website https://spaculture.eu/cs (“Website”) and also to all personal data processed by Spaculture (ii) on the basis of performance of legal obligations, (iii) on the basis of legitimate interest and also (iv) on the basis of performance of a contractual relationship or on the basis of preparation of a contractual relationship.

To make it easier for you to navigate our privacy policy, we have divided the text according to your relationship with Spaculture, and below we provide an overview of the chapters, indicating the main points they contain.

Customer

If you have purchased our products from us, shopped in our customer e‑shop or used our services, you are our customer and we will process your personal data to the extent set out below. In the case of our legal entity customers, we process the personal data of natural persons who represent the legal entity customer.

Spaculture processes personal data both manually and automatically.

Spaculture may also process other data about its customers, which the customers voluntarily provide to it, for the purpose of fulfilling the contractual relationship to which the customer is a party and/​or on the basis of Spaculture’s legitimate interest in establishing and maintaining good business relations and making business communication more efficient.

Processing of personal data of third parties

Third-party personal data, i.e. personal data that Spaculture receives from the customer in connection with the conclusion or performance of the contract, will be processed in accordance with the applicable legal provisions on the protection of personal data.

Recipients of personal data

Spaculture will only make your personal data available to authorised employees or individual contractually agreed processors (e.g. IT suppliers, external accountants, etc.) and possibly other controllers of personal data (e.g. lawyers, auditors) and only to the extent necessary to fulfil the individual processing purposes. The current list of recipients of Spaculture’s personal data is available upon request. Please also note that under certain circumstances Spaculture may be entitled or obliged to disclose some of your personal data to public authorities on the basis of applicable legal regulations.

Retention period for personal data

We process and store your personal data for as long as is necessary to ensure all rights and obligations arising from the relevant contractual relationship, for as long as is necessary to provide customer services and for as long as Spaculture, as the controller of the personal data, is obliged to store the personal data in accordance with generally binding legal provisions. In other cases, the processing period is determined by the purpose of the processing or by the legal provisions on the protection of personal data.

We process the customer’s personal data according to the purpose of the processing for the period indicated below:

If you do not wish to receive our commercial communications and offers, you can let us know at any time, for example by sending an email to gdpr@spaculture.cz, and we will stop sending them immediately.

Potential customer

If you have expressed an interest in purchasing our product, for example by asking us to send you a quote, we will consider you to be a potential customer and we will process your personal data as described below.

Spaculture processes personal data both manually and automatically.

Spaculture may also process other information about prospective customers that prospective customers voluntarily provide to Spaculture for the purpose of negotiating the conclusion of a contract to which the prospective customer is a party and/​or on the basis of Spaculture’s legitimate interest in establishing and maintaining good business relations and streamlining business communications.

Processing of personal data of third parties

Third-party personal data, i.e. personal data that Spaculture receives from a potential customer in connection with the preparation of a contract, will be processed in accordance with the applicable legal provisions on the protection of personal data.

Recipients of personal data

Spaculture will only make your personal data available to authorised employees or individual contract processors (e.g. IT suppliers) and possibly other personal data administrators (e.g. lawyers, auditors) and only to the extent necessary to fulfil the individual processing purposes. The current list of recipients of Spaculture’s personal data is available upon request. Please also note that under certain circumstances Spaculture may be entitled or obliged to disclose some of your personal data to public authorities on the basis of applicable legal regulations.

Retention period of a potential customer’s personal data

Spaculture processes and stores your personal data for the period necessary to ensure the purpose of the processing, i.e. for the duration of the negotiations for the conclusion of the contract and for a maximum period of 6 months.

Personal data will be kept for the purpose of sending commercial communications and offers of products and services, if you give us your consent to this processing, for a maximum of 5 years or until you withdraw your consent. If you do not wish to receive our commercial communications and offers, you can notify us at any time by sending an email to gdpr@spaculture.cz and Spaculture will immediately stop sending commercial communications.

CALLER TO THE SPACULTURE TELEPHONE LINE / SENDER OF AN E‑MAIL QUESTION, INITIATIVE, REQUEST

If you call Spaculture on the customer phone line with a question, reminder, request or other matter, the call will be recorded. If you do not want the call to be recorded, you can contact us by email or write to us at our postal address. The reasons why we record the call and how long we keep the recording are set out below.

Spaculture may also process other data relating to its business partners, or natural persons representing business partners, with regard to the legitimate interests of Spaculture, to maintain good business relations with business partners, to streamline business communications and also for the purpose of fulfilling the contractual relationship with business partners.

Processing of personal data of third parties

Personal data of third parties, i.e. personal data of employees and customers of Spaculture’s business partners and other natural persons who cooperate with Spaculture, or other data that Spaculture receives from the business partner in connection with the conclusion or fulfilment of the contract, will be processed in accordance with the applicable legal regulations in the field of personal data protection. Such personal data will be used by Spaculture for the purpose of fulfilling the contract with the business partner. The business partner hereby acknowledges that Spaculture will process the personal data of third parties for the duration of the contractual relationship and, if applicable, for the period determined by special legal regulations. The data will then be stored for a longer period if there is a justified need to store the data in connection with a specific case. The business partner is obliged to properly instruct its employees, customers and other natural persons involved in the cooperation with Spaculture on the business partner’s side about the processing of Spaculture’s personal data.

When you participate in events organised by Spaculture, we process your data in accordance with the following.

The personal data of visitors to events will be processed mainly for the following purposes (depending on the nature of the event)

- To ensure the organisation of the event,

- Providing information about the event,

- processing the results of the event.

For the above-mentioned purposes, the following personal data of the event participant will be processed in particular

- photo and video documentation of the event.

DATA SUBJECTS’ RIGHTS

The data subject has legal rights in relation to the processing of personal data, which he or she may exercise at any time. These rights are: (i) the right of access to personal data, (ii) the right to have inaccurate or incomplete personal data corrected, (iii) the right to have personal data deleted if it is no longer needed for the purposes for which it was collected or otherwise processed, or if it is found to have been processed unlawfully, (iv) the right to restrict the processing of personal data, (v) the right to portability of data, (vi) the right to object to the processing of personal data, after which the processing of personal data shall be terminated, unless it is proved that there are serious legitimate reasons for the processing which override the interests or rights and freedoms of the data subject, in particular if the reason is the possible enforcement of legal claims, and (vii) the right to contact the Office for Personal Data Protection (www. uoou.cz).


Right of access to personal data: If you want to know whether Spaculture is processing your personal data, you have the right to obtain information as to whether your personal data is being processed and, if so, you also have the right to access your personal data. In case of unjustified, unreasonable or repeated requests, Spaculture will be entitled to charge a reasonable fee for a copy of the personal data provided or to refuse the request (the same applies to the exercise of the rights listed below).

Right to correct inaccurate or incomplete personal data: If you believe that Spaculture is processing inaccurate or incomplete personal data about you, you have the right to request that it be corrected or completed. Spaculture will correct or complete the data without undue delay, but always taking into account the technical possibilities.

Right to erasure: If you request erasure, Spaculture will erase your personal data if (i) it is no longer necessary for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for processing your personal data, or (iv) Spaculture is required to erase the data by law.

Right to restrict the processing of personal data: in the event that you request the restriction of the processing, Spaculture will deactivate, temporarily delete or store the personal data or carry out other processing operations that are necessary for the proper exercise of the right exercised.
Right to data portability: If you want Spaculture to transfer personal data to a third party, you may exercise your right to data portability. If the rights and freedoms of other persons are affected by the exercise of this right, Spaculture will not be able to comply with your request.

Right to object: the right to object to the processing of personal data that are processed for the purpose of fulfilling a task carried out in the public interest or in the exercise of public authority or for the purpose of protecting the legitimate interests of Spaculture. If Spaculture does not prove that there is a serious legitimate reason for the processing that outweighs the interests or rights and freedoms of the customer, it will terminate the processing based on the objection without undue delay.
